Over the years, we have found that many of our clients are deeply concerned about asset protection. They are afraid that what they have spent a lifetime to accumulate will be lost to creditors or predators.

As we have listened to our clients, we have heard them tell us that their concerns fall into several major categories:

  • Remarriage of a spouse after the client’s death
  • A child or grandchild who is simply unable to responsibly fulfill a mature adult role
  • In-law issues, wherein a child’s spouse may wastefully consume any inheritance
  • Liability of heirs due to lawsuits
  • Taxation
  • Financial abuse of a surviving spouse by a loved one or care provider

Over the years, we have created and implemented strategies to assist individuals who have these concerns. If you would like to discuss these matters in a confidential manner with an attorney, contact Fredrick P. Niemann at 888-800-7442 or email him at info@elderlawcenter.com.

HOW CAN I PROTECT MY FAMILY AND A LIFETIME OF WHAT I WORKED TO SAVE?

Most people are interested in protecting their family. They may be currently healthy, but they want a strategy to be prepared for the real possibility that some day, they will be incapacitated.

Long-term care is expensive. When someone in your family needs the services of an assisted living or nursing facility, the cost of their residential care can be $5,000 - $12,000 a month or more. We have worked with clients to assist them in developing an estate, asset and life care plan with appropriate protections in the event that they are disabled and therefore unable to adequately manage their personal and financial affairs.

Often, traditional estate planning attorneys develop documents primarily to serve in a death to distribute and minimize taxes. However, 50% of the individuals alive today who are 65 years of age or older will spend some period of their lives needing physical and/or custodial care. As such, in your planning, you should consider having your documents written in such a way that you dictate how you wish to be cared for in this type of situation.

If you would like to discuss your estate planning in a confidential manner, call us today. We want you to achieve peace of mind. We will listen to what you have to say, so that we can learn your most important desires. Contact Fredrick P. Niemann at 888-800-7442 or through email at info@njelderlawcenter.com.

HOW CAN I PROTECT MY FAMILY?

How can I protect my family if either someone is already admitted to a nursing home or is about to be placed in a nursing home.

Don’t go broke and don’t lose your house!

We define a Medicaid crisis as a situation where an individual has either been admitted to an assisted living or nursing home or is about to be placed in a nursing home, and they have been told that they have too much money/assets to qualify for Medicaid. The family is dealing with long-term health care costs that can range from $5,000 to $12,000 per month and the only source to pay those expenses seems to be the family’s life savings.

An elder law attorney can assist you with developing strategies that strive to qualify a loved one for Medicaid and preserve the maximum amount permissible, even if you have been told by nursing home intake staff, social workers, Medicaid workers and others that your loved one does not qualify for Medicaid.
